While overall base spending has changed little from the House adopted version of H.439, the Senate spending plan is significantly different due to the inclusion of appropriations from the American Rescue Plan Act (ARPA ). The House had little time to consider funding ARPA, as the federal spending bill had just been enacted when the House passed H.439. As a result, the Senate Appropriations Committee did most of the work in deciding how to allocate ARPA funds. When the budget reached the Senate, Gov. Phil Scott offered his own proposal on ARPA spending. The Senate version of H.439 generally aligns with the governor’s proposal in terms of targeting ARPA funding. The Senate spending plan differs significantly from the governor’s proposal in terms of the amount of ARPA funding allocated.

Governor Scott asked the Senate to appropriate approximately $ 1 billion in ARPA spending, the total amount available for the state budget. The Senate has decided to approve about half of the funding in fiscal year 2022, with the intention of returning in the next session to allocate the remainder. The governor’s and Senate’s plans would spend ARPA money over several fiscal years, as federal guidelines allow. Because the spending will take place over several years, the Senate decided not to allocate about half of ARPA’s money, allowing the legislature to have more of a say in budgeting for the. next year. If the legislator approved the full amount in FY2022, it would give the administration more leeway to allocate funds during the duration of the spending process.

The result is a disagreement between the Senate and the administration over the budget. The administration takes the position that by limiting appropriations to half of ARPA’s funding, the Senate is not acting quickly enough to support recovery from the COVID-19 pandemic. The Senate maintains that approving all the money now would give the administration too much control over the process and that its budget does not limit recovery since those dollars will not be spent for years to come anyway. Another added twist in the end-of-session budget reconciliation is the fact that the House didn’t have much time to consider funding ARPA.

These dynamics combine for a potentially turbulent conference process for the budget in the final weeks of the session. The legislature plans to adjourn by the third week of May, and as with most legislative sessions, the past few weeks seemed poised to include a healthy dose of political posture between the House, Senate and the office of the governor.

The Senate approved ARPA funding in the following installments (in millions):

  • Health, Welfare and Justice System – $ 27.5
  • Workforce, higher education and economic development – $ 132.7
  • Housing – $ 18.5
  • Connectivity, Broadband, and Technology Modernization for Government Systems – $ 153.8

STUDENT WEIGHTING

On Thursday, the House Education Committee voted unanimously to approve its version of Article 13, a bill that proposes to create a legislative task force to create an implementation plan for an updated education funding formula. The updated formula was recommended in the Student Weighting Factors report prepared by the University of Vermont and Rutgers University in 2019. The report conclusively documented that although Vermont has the constitutional obligation to provide all students with equitable educational opportunities, the real costs of educating children of different circumstances have not been taken into account. This includes children who attend small schools, children in rural areas, economically disadvantaged children and children who are learning English. Because the funding formula does not meet the real needs of these populations, and because districts that spend beyond a certain threshold are penalized, districts that educate these types of learners have a lack of fiscal capacity and are unable to provide the necessary resources to their students.

The version of section 13 adopted by the Senate creates a wide range of considerations for the task force to take into account. Supporters of an updated formula objected to the bill’s breadth because it did not bind the task force to creating a plan to implement the report’s recommendations. The House Education Committee had long and heated debates on how they should be prescriptive with task force accountability and they narrowed it down somewhat. The House Education Committee amendment requires the working group to consider how to integrate the ratio weighting calculations with the Vermont equalized student calculations, the overspend threshold, and the performance calculations. The House Ways and Means Committee is currently reviewing Article 13. Stakeholders who advocate the implementation of the corrected weights continue to push for a narrower focus.

The bill also ensures that electric bicycles are not subject to registration, insurance or licensing requirements.

A cyclist was fined after attaching a gasoline engine to his bicycle to help him climb steep slopes.

Lee Middleton, 37, admitted to using a motor vehicle without insurance, driving a vehicle without a license and riding a motorcycle on a road without a protective helmet at Teesside Magistrates’ Court on Thursday.

Teeside Live report that Middleton was arrested by police on January 11 after hearing a “ very loud engine noise ”.

Middleton had fitted the bike with a small gasoline engine to help it manage the steep slopes in his area.

However, he was told his modifications meant the motorcycle was now classified as a motor vehicle and therefore required a license, insurance and a helmet.

An engine powered by a gas tank moved the rear wheel, the judges learned.

Paul Dixon, mitigating, said Middleton ‘had difficulty’ going up and down a steep hill on his bike, and the motor was designed to help him when he was caught by an officer in Errington Street.

He said: “The motor is such a small motor that it helps a bit to go up hills but wouldn’t get you to high speed.

“The offense was committed in ignorance of the law.”

Magistrates sentenced Middleton, of Brotton, to a fine of £ 120, a victim fine surcharge of £ 34 and costs £ 85 – a total of £ 239.

TALLAHASSEE (CBSMiami / NSF) – Struggling with problems in the home insurance market, Florida lawmakers on Friday passed a plan that could result in larger rate hikes for clients of Citizens Property Insurance Corp. lawsuits.

But the plan was not as ambitious as a Senate proposal that would have effectively passed more costs to many homeowners when they suffer roof damage.

Banking and Insurance Senate Speaker Jim Boyd R-Bradenton said everyone “has to give a little” in negotiations on the bill (SB 76).

But he said it would strengthen an insurance market that has seen large rate hikes and policies pouring into citizens’ property insurance.

“I believe this will help the market to rebuild itself,” said Boyd, the sponsor of the bill.

The bill, however, drew criticism from some lawmakers who said it went too far – and others who said it did not go far enough. Senator Annette Taddeo, D-Miami, complained about the prospect of increased rate hikes for Citizen customers.

“There is no sugar coating,” Taddeo said. “It will literally increase the prices.”

But Senator Jeff Brandes, R-St. Petersburg said the bill would not solve the financial problems in the insurance market.

“We are on an unsustainable trajectory,” Brandes said. “This bill is 40% of what it was supposed to be.”

The Senate voted 35-5 to approve the bill, and the House followed with a 75-41 vote. Bill now goes to Governor Ron DeSantis.

The bill came against the backdrop of regulators last year signing dozens of rate increases exceeding 10%.

In addition, as the insurance market has tightened, citizens have won over 120,000 policies in the past year.

The insurance industry reports issues such as court costs and questionable or even fraudulent roof damage claims.

Additionally, officials say Citizens, which was created as an insurer of last resort, often charges lower premiums than private insurers.

Lawmakers such as Brandes say the growing number of citizens poses a major financial risk to the state. But the issue of raising citizens’ rates is politically sensitive because homeowners in some areas have little or no other coverage options.

The bill would make a series of changes. They include:

– Allow larger annual rate increases for Citizens customers. These increases are currently capped at 10 percent, but this limit would be gradually increased to 15 percent.

– Prevent contractors from soliciting homeowners to file insurance claims, including offering homeowners incentives. This part of the bill seeks to curb roof damage claims. It also aims to prevent public adjusters from offering incentives to inspect roofs.

– Take measures to try to limit the fees of lawyers who represent owners in lawsuits against insurers. This involves the use of a formula that would examine how much money is awarded in court judgments and how much money has been offered by insurers to settle claims before lawsuits.

– Reduce the time limit for filing complaints from three years to two years, with an additional year for additional complaints.

The Senate initially called for more far-reaching changes to attorney fees and roof damage claims. In part, he proposed creating a “payback schedule” that would have allowed insurers to sell policies with reduced payments for repair or replacement of roofs over 10 years old. For example, insurers could have reimbursed 70% of the costs of metal roofs over 10 years old and 40% of the costs of concrete and clay tile roofs.

The change would have resulted in passing more costs on to many homeowners when they suffered roof damage. But the House balked at the idea, which was not included in the final bill.

Like Brandes, Sen. Doug Broxson of R-Gulf Breeze expressed concern that lawmakers continue to “hit the ball on the road without making major changes.”

But Senator Gary Farmer, D-Lighthouse Point, likened the insurance industry to “Chicken Little” and took issue with arguments about major financial problems among insurers.

“It’s a fabricated crisis – a completely fabricated crisis,” Farmer said.

Bicycle thefts have increased during the coronavirus pandemic, with the highest number reported in southwest London, new data shows.

Admiral home insurance found that stolen cycles accounted for 32% of all claims since March 2020, up from 14% the year before.

London is the bicycle theft capital of the United Kingdom, with the city’s east, north and south-east regions also in the national top ten.

Twickenham, Sutton, Watford, Croydon, Dartford, Enfield, Bromley, Uxbridge, Romford, Harrow and Ilford suffered the most from thefts in the M25.

Suburban Harriet, of Islington, assaulted at knife point for her electric bike on the way to work, wrote in her victim impact statement on the Stolen Ride site: “I have been threatened with stab wounds.

“The theft made me nervous and I am now driving with a personal attack alarm.”

Delivery man Telle, from Walthamstow, added: “I used my bike for work while I was off work.

“Flying took my freedom and helped me with mental stability through physical training.

“It was given to me by my partner who broke his stomach to pay for it.”

Rosie, from Wandsworth, unemployed during the pandemic, said friends had to fund a replacement cycle.

She added: “I live in an apartment in a closed meow. Having my bike stolen from the indoor bike racks felt like a violation of my basic human need to feel safe.

The latest Met figures show 26,402 bikes were stolen between February 2020 and March this year, with violations peaking in September (3,129) – the highest on record.

This compares to 22,203 of the previous 13 months, an increase of 19%.

All the figures are probably considerably underestimated.
